Cloud Terms of Service

These Cloud Terms of Service ("Terms") govern your use of the WorldWideView Cloud Platform and Demo instances, provided by Tri Phung trading as WorldWideView ("we," "us," or "our"). By creating an account or accessing the Cloud Platform, you agree to these Terms.
If you are downloading the software to run on your own hardware, please refer to the End User License Agreement (EULA) instead.
1. Description of Service
WorldWideView Cloud is a managed, real-time geospatial intelligence platform offering a 3D globe visualization environment and an ecosystem of data plugins.
2. Account Registration
You must provide accurate and complete information when registering an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3. Subscription, Tiers, and Billing
WorldWideView Cloud is offered under the following tiers:
- Local: Free: $0 forever. This tier refers to the self-hosted downloadable software, governed by the EULA. It is not a cloud service.
- Cloud: Basic: $19/month. Includes zero-setup managed hosting, Google 3D Tiles, 1st-party live data, and 1 user seat.
- Cloud: Pro: $79/month per seat. Includes shared team workspaces, synchronized filters, unlimited historical data, and priority support.
- Enterprise: Custom pricing. Contact sales for air-gapped deployments, custom implementations, and high-throughput API access.
Billing Terms:
- Subscriptions are billed monthly via Stripe.
- Subscriptions auto-renew unless cancelled before the end of the current billing cycle.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period.
- We do not provide refunds for partial billing periods.
- We will provide at least 30 days' advance notice via email of any price changes.
4. Acceptable Use
Your use of the Cloud Platform must comply with our Acceptable Use Policy. Prohibited actions include, but are not limited to:
- Scraping data engine WebSocket streams.
- Using the platform for active military targeting, life-safety navigation, or illegal surveillance.
- Attempting to bypass rate limits or authentication mechanisms.
- Sharing single-seat credentials across multiple users.
5. Intellectual Property
- Our IP: We own all rights, title, and interest in the WorldWideView platform, code, UI, and branding.
- Your IP: You retain all rights to any custom GeoJSON configurations or custom data you import into your private workspace.
- Plugin Content: Third-party plugins are owned by their respective developers under the Developer Distribution Agreement.
6. Data Accuracy Disclaimer (Important)
WorldWideView aggregates data from open-source feeds, public APIs, and community contributors. ALL GEOSPATIAL, AVIATION, MARITIME, AND EVENT DATA IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not guarantee the real-time accuracy, completeness, or reliability of any data displayed on the globe. You expressly agree that WorldWideView shall NOT be used for:
- Air traffic control or aviation navigation.
- Maritime navigation.
- Emergency response or disaster management.
- Life-safety decisions of any kind.
7. Third-Party Plugins
The WorldWideView Marketplace allows you to install third-party plugins. These plugins execute in your browser. We do not endorse, guarantee, or assume liability for the security, quality, or accuracy of third-party plugins.
8. Service Availability and Maintenance
We strive to provide reliable service but do not guarantee 100% uptime (unless explicitly defined in an Enterprise SLA). We reserve the right to perform routine maintenance, which may cause brief interruptions. We are not liable for outages caused by third-party APIs or upstream data providers.
9. Termination
You may terminate your account at any time. We reserve the right to suspend or terminate your access immediately, without notice, if you violate these Terms or the Acceptable Use Policy. Upon termination, your right to use the Cloud service ceases immediately.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WORLDWIDEVIEW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
Prior to filing any legal action, you agree to attempt to resolve the dispute informally by contacting us at legal@worldwideview.dev for a period of 30 days.
